Terms of Service

These Terms of Service ("Terms") govern your use of the FlagRisk platform, including our website at flagrisk.org, our surveys, waitlist, beta testing programme, and any related services (collectively, the "Services") operated by FlagRisk Inc. ("FlagRisk", "we", "our", or "us").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using FlagRisk's Services, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Services

FlagRisk is a pre-launch safety intelligence platform that provides:

• A community waitlist for individuals interested in real-time personal safety alerts.
• Community safety surveys to understand user needs and safety patterns.
• A beta testing programme for early adopters who wish to help shape the product.
• A blog and community hub featuring safety insights and project updates.
• A demonstration live safety map showing simulated safety alerts for Nigeria, Kenya, and South Africa.

Important: FlagRisk is currently in pre-launch phase. The live map displayed on our platform is for demonstration purposes using a curated risk library. It does not represent real-time verified incidents. Do not rely on this map for actual safety decisions.

3. User Obligations

By using our Services, you agree to:

• Provide accurate, current, and complete information when submitting forms.
• Not use the Services for any unlawful or prohibited purpose.
• Not attempt to gain unauthorised access to any part of our platform or systems.
• Not submit false, misleading, or fraudulent information.
• Not use automated tools to scrape, crawl, or extract data from our platform without permission.
• Respect the privacy of other community members whose information may appear on public pages.

4. Beta Tester Agreement

If you enrol as a beta tester, you additionally agree to:

• Provide honest and constructive feedback on your experience with the platform.
• Report bugs and issues in a timely manner through our designated channels.
• Keep beta features, unreleased functionality, and confidential product information private until FlagRisk authorises their disclosure.
• Not share beta access credentials with unauthorised individuals.
• Participate in good faith in the testing process.

Failure to comply with these obligations may result in termination of your beta tester status and forfeiture of associated benefits.

5. Intellectual Property

All content on the FlagRisk platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of FlagRisk Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

By submitting content, feedback, or survey responses to FlagRisk, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and incorporate that content into our Services for the purposes of improving our platform and services.

6. Community Content and Leaderboard

When you participate in FlagRisk activities (surveys, waitlist, beta testing), your first name and a partially masked email address may appear on our public Leaderboard and Contributors pages. By participating, you consent to this display. You may request removal from public pages by contacting us at flagrisk@gmail.com.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FLAGRISK DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE LIVE SAFETY MAP IS FOR DEMONSTRATION PURPOSES ONLY AND DOES NOT REPRESENT REAL-TIME VERIFIED SAFETY INFORMATION. DO NOT MAKE SAFETY DECISIONS BASED ON THIS DEMONSTRATION DATA.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAGRISK INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

9. Indemnification

You agree to indemnify and hold harmless FlagRisk Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Services or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Lagos, Nigeria.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
